Recently, our company noticed that Mitsubishi Chemical Co., Ltd. (hereinafter referred to as "Mitsubishi Corporation") issued a copy of the Chinese Patent Reexamination Board's rejection of the red phosphor patent invalidation request submitted by our company, deliberately distorting the facts, attacking us, against me. The reputation of the company has had an extremely bad impact. Our company hereby solemnly declares as follows:
First of all, the Chinese Patent Reexamination Board, as the administrative body that examines the request for invalidation of patent rights, has to pass the test of the first and second levels of judicial procedures if the decision made by the review is final. Because we do not agree with the agency's review decision, in order to safeguard the legitimate rights and interests of our company, our company is actively preparing relevant evidence and materials, and suing the Beijing Intellectual Property Court and the subsequent Beijing Higher People's Court and even the Supreme People's Court in accordance with the law, requesting the court's decision. The Patent Reexamination Board revoked the original review of the decision.
Secondly, regarding the case of Mitsubishi Corporation’s complaint against LED red phosphor infringement in Shenzhen, at this stage, it is in the stage of judicial appraisal. It is necessary to wait for the administrative litigation and related trial results decided by our company for the above review. At present, no first-instance judgment has been made. The procedure has not yet started, and it is not enough at present to judge the final conclusion. Before the case was awarded the final judgment of the Guangdong Higher People's Court, our company will take an active role in responding to the legitimate interests of China's LED phosphor companies.
Thirdly, as a well-known brand enterprise in the LED phosphor industry, Hilde has the courage to face the competition in the industry and dare to bear the consequences of competition. The patent dispute case is the focus of the domestic LED phosphor industry. The trial of the case requires a long time, and our company is fully prepared for the long-term complex battle.
